Suttle’s recall lawsuit dismissed

Mayor Jim Suttle could find out Saturday if he will face a recall election after District Judge Peter Bataillon refused to extend the Dec. 4 deadline for verifying the 37,000 signatures submitted by the Mayor Suttle Recall Committee. The Douglas County Election Commission needs to validate that at least 26,643 of those signature came from registered Omaha voters. Suttle sought an injunction allowing an additional 75 days to verify signatures, based on alleged irregularities witnessed during the collection period by anti-recall group Forward Omaha. Bataillon rejected the motion, but said the court still has the ability to intercede at a later date to examine potential instances of fraud. The mayor says he would not seek further legal action if the extension was denied.
